Introduction

Purpose of this document Nestlé has been committed to environmentally sound businesses practices throughout the world since its early days. The Nestlé Corporate Business Principles and The Nestlé Policy on Environmental Sustainability commit the Company to respect and comply with existing laws and regulations concerning the environment in local markets, and to apply Nestlé internal standards suitable to local conditions in those regions where specific environmental legislation is non-existent or insufficient.   The Nestlé Environmental Management System (NEMS), in place since 1995, establishes a management process enabling Nestlé to control and improve its environmental performance. NEMS comprises the core document described in GI-14.001, as well as a suite of internal standards and guidelines providing additional definition regarding specific technical and operational requirements applicable to environmental management, which includes this document.   This document defines and updates a set of Nestlé Environmental Requirements (NER) which are mandatory across all Nestlé operations involved in handling products. Whilst their primary application is in those jurisdictions where environmental legislation is non-existent or under-developed, they must be met where applicable by all such Nestlé operations regardless of location.

Major changes This instruction is an update of GI-14.020 and is designed to ensure clarity across the Nestlé Group as to minimum requirements for environmental protection. It removes non-mandatory requirements and updates remaining mandatory requirements to accepted internal and external best practices.

Target Audience This instruction is addressed to:   1. Heads of all Nestlé Markets / Globally or Regionally Managed Businesses who are accountable for its implementation; 2. Technical Managers and Supply Chain Managers of Nestlé Markets / Globally or Regionally Managed Businesses who are responsible for implementation for all functions within the Market / Business (typically delegated); 3. Market / Globally or Regionally Managed Business Chief Engineers and Environment Managers who are responsible for driving implementation in their Market / Business; 4. Plant Managers who are responsible for the implementation in their Plants (as applicable); 5. Plant Engineers and Plant Environment Managers, who are responsible for driving implementation in their Plant (as applicable); and 6. PTC and R&D Heads, PTC and R&D Engineers and Environmental managers, who are responsible for the implementation in their units (as applicable) 7. Anyone else involved in the implementation or verification of this instruction.   The primary audience for these NER are those Nestlé facilities which handle products, ingredients and raw materials (including factories, distribution centres, trans shipping points, cross docks, Research & Development facilities and Nestlé-owned milk collection centres). These minimum requirements also apply to other facilities (head office, data center, etc.) with an assessed significant environmental impact in one or more of the areas covered. In relation to all other Nestlé facilities, these NER are to be considered as non-mandatory guidelines.

Use of this Document This instruction is a Nestlé-specific “other requirement” under NEMS (GI-14.001-1). It does not provide any advice as to the achievement of these minimum requirements for environmental protection; such advice and other supporting documentation may be found on the Nestec CO-ENG intranet site and the CO-SH&E intranet site   In applying the NER, the following hierarchy have been defined to provide appropriate guidance:   i) In all Markets, Nestlé will always meet the environmental standards defined in this document ii) Where local legislation requires higher or tighter standards, these will apply. iii) Technological solutions delivering outcome beyond those required above may be necessary in particular circumstances, for example to respond to the needs of local communities.

Implementation An annex to this document, NER checklist, provides a checklist for Plants to determine their degree of implementation of these requirements and to establish actions to address any identified issues. Where these requirements are not currently met, an action plan must be established and implemented to achieve compliance.   The implementation summary is the recommended approach to ensure compliance with the requirements in this document. In cases where this approach is not possible or desirable alternative options to ensure compliance can be chosen but need to be documented.   In rare situations where compliance with a particular requirement is not possible and/or not desirable, a written application for exemption must be made. The included justification must contain an Environmental Impact Assessment prepared by a team which involves a qualified third party. The application must be made to Zone/Business Technical Management or Zone/Business Supply Chain Management respectively or CT-R&D. CO-SHE/CO-Eng technical experts will be involved in the assessment. A formal written response must be received   CO-SHE maintains a central register of all applications for exemption, including a summary reasoning for grant or rejection of exemption, which will be published on the CO-SHE homepage and reported to the Corporate Executive Board Member responsible for Operations.   For new acquisitions and new requirements in this revision, a time frame for compliance with the NER of no more than 3 years is mandatory. As part of this, an action plan for achieving compliance with these requirements must be established.

Definitions and Abbreviations For the purposes of this instruction, the following definitions and abbreviations apply:   NEMS The Nestlé Environmental Management System NER Nestlé Environmental Requirements Plant Includes every site in Nestlé which is a Manufacturing Site (Factory or Producing Plant), Distribution Center, Shared Service Center or Head / Regional Office, and which carries out production, sales and distribution, storage of inventory or purchasing, as well as specialised sites involved in training (e.g. Rive Reine) and research and development (including R&D Centres and Product Technology Centres.
